How can I get access to website files when the developer goes missing or cant be contacted?

I have contacted the web host but they cant help because of security reasons,they offered to pass on my email to the account holder but stated they can't compel them to reply. The account holder has not responded and the website is still down. Is there any way to get access to the files?
