True. But you can creata a dump file of your database and add it to the repository. You could even write a script to make that an automatic process. With database or without, it's at least one more place to have your code and assets backed up to, with the primary benefit of version control on all that stuff anyway.

Some of your answerers are very hopeful for your chances in this fight, but as someone with some experience with trademark and domain issues personally, I can tell you the waters are pretty muddy, and it's not as simply as it may seem to fight for domain IP with your trademark. Sometimes it can come down to who has the most resources to pay lawyers. But definitely try to pursue the suggestions that have been made.

You probably should just get in touch with his web developer to find out if you really want to know. Obviously don't come at him with, "So, what crappy fake SEO tricks are you pulling with my relatives site?". But you could get in touch and pick his brain with something like, "I hear you have some special SEO techniques you are using to help my relatives site. Can you tell me more about your strategies?"

comment MODX based site has been compromised, and tagged by Google as malware
UPDATE: upgrading my version of the CMS seems to have resolved the issue. While I found no actual code in the markup that Google claimed to have found, the upgrade apparently addressed the security vulnerability, and Google has un-tagged the site as malware. Thanks!
